The Freedom From Religion Foundation (FFRF) contends that this involvement breaches the Establishment Clause of the First Amendment by intertwining government functions with religious activities. However, legal experts, including those from the First Liberty Institute, assert that such chaplaincy programs are constitutionally permissible. They reference the Supreme Court's decision in Kennedy v. Bremerton School District, which upheld a public employee's right to engage in personal religious expression. Therefore, Sanders' actions align with established legal precedents protecting religious freedoms in public settings.
